INTRODUCTION
STRETTO- YOUNG PIANISTS COMPETITION R.A (the “Association” or “We” or “Our”) respects your privacy. This Privacy Policy explains what information is collected by us when you enter and use our Website  (the “Website”) and how and why we collect the information we do. It also explains how we may use this data, and what rights you have in that regard. 


In general, we collect personal information directly from you  upon the submission of an application to participate in a piano competition endorsed on our Website (a “Competition”). We only request personal information that is necessary and relevant for this purpose. Furthermore, we only use your personal information for the specific purpose for which you provided it to us, and we process it in a lawful and transparent manner.


If you are a minor, or if you are reading this Privacy Policy on behalf of a minor who is under your guardianship, please refer to the Section on Minors and Privacy, below.


Any capitalized terms not defined herein shall carry the meaning assigned to them in the Terms of Use .


Please read this Privacy Policy carefully. If you do not wish for your information to be collected and used as detailed herein, please refrain from applying for Competitions using the Website .  This Privacy Policy is intended to be read and consented to in tandem with the Terms of Use, and you may not apply for Competitions unless you have consented to both documents.

CONTROLLER
Under the EU General Data Protection Regulations (the “GDPR”), we are classified as a 'Controller' of the personal data you may provide us with, and in accordance with the GDPR we will make efforts to ensure that all the personal data we hold about you is, at all times meets the GDPR standards (the “Standard”): 
1. Used fairly, lawfully, and transparently; 
2. Collected for specific, explicit and legitimate purposes; 
3. Adequate, relevant to and limited; 
4. Accurate and can be kept up-to-date; 
5. Not kept in a form which permits your identification for longer than is necessary; and 
6. Held securely. 

 

As a Controller, we are required to demonstrate compliance with the foregoing Standard, and this Privacy Policy is one of the ways in which we meet our accountability requirements under the GDPR.

WHAT INFORMATION DO WE COLLECT AND HOW DO WE USE IT? 
If you fill an application to a Competition using the Website, we may collect the following information:

•    Full name;
•    Date of birth - collected to ascertain whether you are a minor, in which case your application must be submitted by your guardian;
•    Age group (from a selection listed under each individual Competition) – collected to ascertain in which age group you wish to compete, in order to examine your professional level in an appropriate manner, and to determine the applicable registration fee;
•    Video/audio sample performance which may include your voice and/or image – collected and used to examine your professional level and suitability for the Competition.
•    Teacher’s full name  – collected to 
•    Email address- used for communication and verification purposes following application;
•    Phone number- similarly, used for communication and verification purposes following application.
•    Recordings (including video and audio) of your performances made as part of a Competition. 

 

Your application to Competitions may also require you to provide us with identification documents, such as a photocopy of your ID or passport which shall be collected and used for identification and verification purposes.


Minors may not register for Competitions. Instead, their guardian may submit their applications for them, in which case the guardian’s information and identification document shall also be required, to verify the guardian’s status as such with relation to the minor.

WHAT DO WE DO WITH YOUR INFORMATION?
Your name, e-mail, date of birth or any other identifiers are used first and foremost for authentication purposes.


We use your personal data in order to recognize you for the purpose of your application for and participation in Competitions, and in order to examine your professional level and suitability for the Competition.


We may correspond with you using your e-mail, phone number or other contact details collected by us, for the purpose of responding to your application, and, to the extent applicable, for coordinating and arranging your participation in Competitions.


We keep a record of your communications with us in order to help us resolve issues and to safeguard you and the Website against fraud and abuse. We also keep a record of all consents you provide.


We may use recordings of performances by you, made as part of a Competition, in combination with your name , to promote the Competition, including via social media and/or third-party websites .

THE LEGAL BASIS FOR THE COLLECTION OF DATA 
Pursuant to the GDPR, processing of personal information is only lawful, if and to the extent that it has a lawful basis for such processing. Under the GDPR there are six lawful bases, as follows:
1. Consent 
2. Necessity for the performance of a contract 
3. Necessity for compliance with a legal obligation 
4. Necessity to protect your vital interests 
5. Necessity for a task performed in the public interest; and 
6. Necessity for legitimate interests, except where such interests are overridden by fundamental rights and freedoms


The legal bases we have for processing of your personal information are, as applicable: (I) with your consent, (II) to perform a contract, and (III) for legitimate interests. 


Consent
When you apply for Competitions, you consent that we use your information in order to identify you and/or the minor on behalf of which you applied, to examine the professional level, age group and suitability for a Competition and to contact and correspond with you regarding the results of your application, including, where applicable, finalizing your registration and coordinating your participation in the Competitions.


Video/audio recordings of performances made by you, as part of a Competition, in combination with your name, may also be posted onto the Association’s social media and/or Website, for the purpose of advertising a Competitions (including future Competitions). We may also request your specific consent in some instances in scopes and contexts as may be detailed in each such request. 


Contract
Your personal data is used, among other things, to authenticate your identity and communicate with you following your application to a Competition, and in connection with such. In addition, we use your personal information to administrate Competitions for which you apply. Therefore, we use your data on the basis that it is necessary for examining your professional level and suitability for a Competition, and for administrating your participation in Competitions. 


Legitimate Interest 
Based on our legitimate interests. We determined our legitimate interest by considering the following: 
The general purpose - your personal information is processed in the framework of the application for participation in a Competition, to the extent necessary to facilitate your application and assessing your professional level and suitability, and, if accepted, participation in, Competitions. 
The purpose of posting video/audio of performances- video/audio of performances made by you, as part of a Competition, is the advertisement of future Competitions.   


Necessity
The processing we do of your personal information is necessary to carry out Competitions. Your participation in Competitions would not be possible without the preliminary collection of minimal identifying information and examination of professional level and adequacy. In addition, considering that the Website is not adapted for direct communications, your contact details are necessary to finalize your registration, and to correspond with you, as well as arrange and coordinate your participation in Competitions.


Therefore, our use of your data is necessary for our legitimate interests in carrying out the Competitions. 


Balancing test
We believe that we are using your personal information in a responsible way and are not overriding your fundamental rights and freedoms.


In cases of posting video/audio recordings of performances made by you in particular, such postings do not override your fundamental rights and freedoms, since Competitions are held in public anyway, posting such performances therefore does not exceed the scope of publicity that participation in Competitions necessitates regardless, especially when publication of such performances usually coincides with the aspiration of a performer for more exposure. 


We will only use your personal data for the purposes for which we collected it as described above, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. 


If we need to use your personal data for an unrelated purpose, we will, if possible, request your specific and explicit consent, and if not will notify you and we will explain the legal basis which allows us to do so. 


INFORMATION MADE PUBLIC 
If you wish to participate in our Competitions then you agree that we may publish your performance made in our Competition in our Website and social media. You may also be occasionally required to provide us with specific consent, to allows us to share certain information with applicable music administrations.

MINORS
It is important to us that minors may participate in Competitions responsibly and lawfully. 
We are committed to safeguarding minors’ personal data collected online, and to helping them and their guardians learn how to exercise control over personal data while exploring the Internet.


We will not collect personal data regarding minors, and will not allow minors to participate in Competitions, unless their application has been submitted by their guardian.

The Website uses Cookies (as the term is defined below), and other technologies of materially similar properties and function, to facilitate its operation and to collect data. “Cookies” are small files placed, by your browser, on the device by which you visit the Website. The text in a cookie often consists of strings of numbers and letters that uniquely identifies your device, but they may contain other information as well. Cookies are used by the Website to store data that can be recalled by a web server in the same domain that placed the Cookie. By agreeing to this Privacy Policy, you acknowledge and agree to the use of Cookies by the Website as described herein.

The Website may contain links to other websites, applications and environments that are not owned or controlled by us (the “Other Sites”). The owners and operators of those Other Sites are responsible for their collection or use of your personal data, and you should check their respective privacy policies and terms of use. Unless specifically referred to otherwise, this Privacy Policy applies to the Website only and not the Other Sites.

SECURITY OF PERSONAL INFORMATION
Safeguarding personal information is important to us. While no systems, applications, or websites are 100% secure, we take reasonable and appropriate steps to help protect personal information from unauthorized access, use, disclosure, alteration, and destruction.  


Except for the Association’s employees and service providers, who are under an explicit obligation to maintain confidentiality, we may share your information with any competent law enforcement authority, if required to do by a judicial order or any other legal directive. 


We may use professional security services in order to safeguard the collected information. Such services may include periodical checks and backups. Nevertheless, we are not responsible for any security faults that may be caused and are beyond our control.


We deploy appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorized way, altered or disclosed (a Data Security Breach). In addition, we limit access to your personal data to those employees, contractors and other third parties who have a business need to know. They will only use your personal data on our instructions, and they are subject to a duty of confidentiality.


We deploy procedures to deal with any suspected Data Security Breach and will notify you and any applicable regulator where we are legally required to do so.

The personal information we collect may be stored and processed in your country or region, or in any other country where we maintain facilities. The storage location(s) are chosen for the efficient operation of the Website.
