Terms of Use
Welcome to ‘Stretto,’ a website dedicated to the organization, presentation of, and registration to, international piano competitions for young pianists (competitions facilitated by the Website, each a “Competition”), owned by STRETTO - YOUNG PIANISTS COMPETITION R.A, an association founded under the laws of the state of Israel (the “Association” and the “Website”, as applicable).

The registration to any competition presented on the Website and use of the Website as a whole, shall be in accordance with and subject to these terms of use (the “Terms of Use”), as may be updated from time to time.

Use of the Website is free and is not subject to or conditional upon any entry fees. Participation in a Competition, however, shall be subject to a participation fee, as detailed below. All users must be adults to use the Website, and to submit an application for any Competition, as further detailed below.

GENERAL
By selecting the box "I agree", or otherwise accessing and using the Website, you understand and acknowledge that use of the Website is subject to: (i) these Terms of Use; and (ii) the privacy policy of the Website, available here (the “Privacy Policy”). The Terms of Use and the Privacy Policy shall be hereinafter collectively referred to as the “Terms of Use”. If you do not accept these Terms of Use or any part hereof, please refrain from using the Website.

The Association reserves the right, at its sole discretion, to change, modify, add to, or remove portions of these Terms of Use, at any time. It is your responsibility to check these Terms of Use periodically for changes. The updated Terms of Use shall always be available on the Website. Your continued use of the Website following the publication of such changes shall be deemed as your acceptance of and consent to these changes.

Without derogating from the foregoing, by using the Website, you hereby confirm that you have read the Terms of Use, understood the content hereof, and consented to be subject to the same.

RESTRICTIONS OF USE
The Website is intended for personal use only and for the (except where adults register minors under their guardianship for Competitions, as further detailed below) and shall not be used for any commercial purpose.

All data and content displayed on the Website, including without limitation, images, names, symbols, logos, musical pieces’ names, and other musical creations and/or references thereto (collectively referred herein, the “Materials”) are Materials owned by the Association and/or other third parties, as the case may be, and which are protected, inter alia, by copyright laws.

APPLICATION FOR COMPETITIONS
Participating in a Competition endorsed on the Website is conditional upon submission of an application (an “Application”, a user who submits an application- an “Applicant”, and an Applicant whose Application is accepted - a “Competitor”) and its approval by the Association. As part of an Application, you (or a minor under your guardianship who you wish to enroll as an Applicant in a Competition, as applicable) shall be required to provide the following personal information, which shall pertain to you, and to a minor under your guardianship, as applicable:
• Full name;
• Date of birth;
• Age group (from a selection listed under each individual Competition);
• Teacher’s full name;
• Email address;
• Phone number;
In addition, the following documents will be required for each application:
• Photocopy of the Applicant’s ID or passport. If you wish to submit an Application on behalf of a minor under your guardianship, you must also attach a copy of your own ID or Passport, which must clearly indicate your guardianship over said minor.
• A photo of the Applicant.
Each Competition may also require the submission of a sample performance of the Applicant in a video or audio file of the types supported on the Website, as will be detailed on the registration page from time to time.

Upon applying to a Competition and as condition thereto you undertake to provide only correct, accurate and complete information. You undertake not to provide incorrect and/or fictitious, in part on in whole, information, for your Application, and/or in such manner that violates these Terms of Use. The Association reserves the full right to ban and/or to remove and/or to prevent participation of users, Applicants or Competitors who, at the sole discretion and judgment of the Association, violate these Terms of Use and/or a Competition’s individual rules.

COMPETITION RULES
Each Competition shall be governed by rules which shall be published in advance on the Website (the “Rules”, each with respect to the corresponding Competition only). The Rules for the 2024 Competition can be found on the following link: Rules | Stretto (strettopiano.org.il).

In any event, the execution of the Rules, including the assessment of any Applicant, Competitor, Application and/or performance, shall be at the Association’s sole and absolute discretion and judgment. The Association’s decisions, including all such matters, shall be final and irrevocable.

PARTICIPATION FEES
Once your Application has been approved, you shall be required to pay a participation fee, as detailed in each Competition’s Rules (the “Participation Fees”). The payment of the Participation Fees is a mandatory step for the completion of an Application to and participation in a Competition. The final date on which the Participation Fees must be paid shall be indicated in the applicable Rules of each Competition, and payment instructions shall be provided by email, using the same e-mail address provided by the Applicant as part of the Application.

Following completion of the registration to the Competition and payment of the Participation Fee (“Final Registration”), the participation in the Competition may be cancelled only in accordance with applicable laws, no later than fourteen (14) days following the Final Registration and provided that at the time of the cancellation there are more than 7 (seven) business days (that are not rest days according to Israeli laws), until the date of the Competition. Cancellation will be subject to payment of a cancellation fee of either: (i) 5% (five percent) of the Participation Fees, or (ii) NIS100, whichever is lower. Following the lapse of fourteen (14) days from the Final Registration, and unless the Competition cancelled by the Association, the Participation Fees shall not be refunded under any circumstances.

For the avoidance of doubt, any expenses incurred for a Competitor’s participation in a Competition (including, but not limited to, flight, lodging and/or other travel expenses) shall be borne by the Competitor alone, and shall not be covered by the Association in any event.

INTELLECTUAL PROPERTY
All proprietary and intellectual property rights (including, without limitation, all copyrights, design rights and trademarks) in the Website, including in the Materials, are the exclusive property of the Association and/or of the third parties from which the Association has duly obtained license or other permission to use (the “IP” or “IP Rights”, as applicable), and/or whose public domain creations are used in the Website. Using the Website shall not be regarded as granting any rights in the IP.
Without derogation from the foregoing, all IP Rights that Applicants and/or Competitors (as applicable) may have in sample performance uploaded or sent by Applicants and played by Competitors during the Competition, shall remain the applicable Applicant's sole and exclusive property and the Association shall not assume any right in the foregoing, provided however, that the Association shall be granted with an irrevocable, non-transferable right and license to use any IP related to the performances played during a Competition, including Competitors’ pictures, images, samples and videos, for the purpose of promoting the Association and future Competitions within the Website and other promotional materials, all subject to and in accordance with applicable copyrights and privacy laws.

LIMITATION OF LIABILITY
The Association and/or anyone acting on its behalf shall not bear any liability under any circumstances and by virtue of any contractual, tortious grounds or any other grounds, toward you or toward any other person in respect of any cost or damage, direct or indirect, special, punitive or incidental compensation of any kind (including, without limitation, damages in respect of impairment of goodwill, loss of data or information, loss of profits, work stoppage, crash or any other problem involving the Website or a Competition) resulting from the use of or from the impossibility of use of the Website or any part thereof.

Without derogating from the generality of the foregoing, except for optional refund of the Participation Fees, the Association shall not bear any liability for the cancelation, alteration, or delay of a Competition. You hereby exempt the Association and anyone acting on its behalf from any liability as set forth in this paragraph.

The Association and anyone acting on its behalf provide the Website, the option to apply for Competitions, and Competitions in and of themselves, including content and services provided in connection therewith on an "As Is" basis, without any declarations, representations, or warranties whatsoever.

The Association does not warrant that the Website shall retain full or partial functionality at any given time. You acknowledge that the Website as a whole, and or any part thereof, may be withdrawn, altered or terminated by the Association no prior notice.
​
The Website and the contents thereof may include errors and faults, including, inter alia, technical, typographical, computational, and photographic errors. The Association and anyone acting on its behalf shall not be liable for any damage, either direct or indirect, which may be suffered by you, as a result of such errors.
​
There may be bona fide mistakes in the data displayed from time to time on the Website. The Association and anyone acting on its behalf shall not be liable for any damage, cost or loss, either direct or indirect, suffered by you as a result of such inaccuracies or partial displays of data.
​
The Website’s functionality depends on factors beyond the control of the Association, such as data and network communications, internet connectivity and/or availability and servers’ networks thorough which the Website will be operated, or the data shall flow in real time to the Website. The Website reserves all rights to, at its sole discretion, cease the Website’s function, either fully or partially, and from time to time, if it shall be disrupted or in case any other factor will prevent the ordinary use thereof.

The Association and Third Parties strive to prevent viruses, Trojan horses, worms, or any other type of software that could harm or impair computer and/or server function and/or cause other harmful use from operating on, impairing, harming the Website. However, the Association and anyone acting on its behalf shall not be liable for any damage, either direct or indirect, which shall be caused to or suffered by you, as a result of the aforesaid.

ADVERTISEMENTS, LINKS AND REFERENCES
Within the Website, you may be exposed to advertisements, links and references, including to links to external websites, other information sources, commercial entities, business, or organizations. The Association has no control over such sources and has no means of overseeing all such content. Furthermore, the Association does not warrant that all links and references that shall be found on the Website shall be functional and lead to an active web page or other source. The presence of third-party advertisements on the Website does not indicate the Association’s consent to or approval of the content of such, does not indicate that the information conveyed thereunder is correct, complete, or up to date.

Any direct or indirect communication between you and third parties through advertisement or any other third-party contents, shall be carried out vis-à-vis said third parties only, under your or such third parties’ responsibility only, as the case may be, and the Association and anyone acting on its behalf shall have no liability or obligation in connection with such communication.

BANNING OR RESTRICTING PARTICIPATION IN COMPETITIONS
The Association may ban or restrict your participation in a Competition, in each one of the following cases: (a) In case of violation or suspected violation of these Terms of Use; or (b) in case that you have committed an act or omission that, in the Association’s sole discretion and judgment, materially impacts your Application or participation in a Competition; or (c) in case that the Association shall, in its sole discretion, determine that you have committed an unlawful act with regard to the Website, the Competition, and/or in connection therewith.

MISCELLANEOUS
These Terms of Use shall be governed by and construed in accordance with the laws of the state of Israel. The exclusive jurisdiction in all matters related to these Terms of Use and any use of the Website shall vest with the competent district courts located in Tel Aviv-Jaffa.
These Terms of Use shall, with regard to the use of the Website, prevail over any other instruction, regulations, information or post presented on the Website or anywhere else, unless explicitly stated otherwise.
